Under the Act, new location information businesses* are allowed to register with Korea Communications Commission (KCC) without obtaining a license. In line with the Act, its Enforcement Ordinance was promulgated on April 19, 2022 seeking to foster the location information businesses and ensure safer use of information and privacy. The provisions include as follows:
- The new business applicant must submit the registration application to the KCC with a business plan attached and undergo evaluation.
- A penalty surcharge is imposed for illegally collecting and using personal location information without a consent.
- The KCC conducts annual inspection to verify the compliance and issue the corrective order for non-complaliance.
