The revised Act on the Protection, Use, etc. of Location Information was promulgated on October 19, 2021. The revision aims to better protect location information and nurture a new industrial ecosystem based on location information by relaxing the requirements. The revisions include as follows:
- The scope of location information is defined to reduce confusion for service providers.
- To ease the entry restrictions on personal location information businesses, the personal location-based service businesses are allowed to simply register with Korea Communications Commission, rather than obtaining the permit.
- A penalty equivalent to 3% or less of sales related to the violation is imposed on a person who collects, uses, or provides the relevant personal location information without consent.
